Terms of Service

These Terms of Service (“Terms”) govern access to and use of pdfstork, operated by 3C SEBIRE, a company based in Switzerland (“pdfstork”, “we”, “us”, “our”).

By creating an account, accessing the dashboard, using the API, subscribing to a paid plan, or otherwise using pdfstork, the user or customer (“Customer”, “you”) agrees to these Terms.

If you use pdfstork on behalf of a company or organisation, you confirm that you have the authority to bind that company or organisation to these Terms.

1. Service description

pdfstork provides a PDF generation API and related tools that allow users to create, manage and render PDF documents from templates and data submitted through the service.

The service may include:

  • access to a dashboard;
  • creation and management of PDF templates;
  • API access;
  • API keys;
  • PDF generation;
  • usage monitoring;
  • account and billing management;
  • support and troubleshooting features.

We may update, improve, modify or discontinue parts of the service over time.

2. Account registration

To use pdfstork, you may need to create an account.

You agree to provide accurate and up-to-date account information and to keep your login credentials secure.

You are responsible for all activity that occurs under your account, including activity using your API keys.

You must notify us promptly if you suspect unauthorised access to your account or API keys.

3. API keys and access

API keys are provided to allow authorised access to the pdfstork API.

You are responsible for:

  • keeping API keys confidential;
  • restricting access to API keys within your organisation;
  • preventing unauthorised use;
  • rotating or revoking keys when needed;
  • ensuring that your use of the API complies with these Terms.

We may suspend or restrict API access if we detect abuse, excessive usage, security risks, suspicious activity, or use that may affect the stability of the service.

4. Customer data and content

You remain responsible for the data, templates, files, variables, text, images, structured data or other content that you submit to pdfstork (“Customer Content”).

You confirm that you have all necessary rights, permissions and legal bases to submit and process Customer Content through pdfstork.

You retain ownership of your Customer Content.

You grant pdfstork the limited right to process Customer Content only as necessary to provide, operate, secure, maintain and support the service.

We do not claim ownership over your templates, API payloads or generated documents.

5. Generated PDFs

pdfstork allows you to generate PDF documents from templates and submitted data.

You are responsible for:

  • the content of generated PDFs;
  • the accuracy of the data submitted;
  • the legality of the documents generated;
  • reviewing generated PDFs before sending, publishing or relying on them;
  • ensuring that generated documents meet your own business, legal, technical or compliance requirements.

pdfstork does not guarantee that generated PDFs will be suitable for every specific legal, tax, accounting, regulatory or business purpose.

6. Templates and API request logs

Users may create and store PDF templates in their account.

For support, debugging and service monitoring, pdfstork may store the last 10 API request logs associated with each account. API request logs may include the full request payload, including data submitted for injection into PDF templates.

Older API request logs are automatically replaced by newer ones.

pdfstork does not store all generated PDF documents by default.

7. Plans, subscriptions and billing

Some features of pdfstork may be available only through paid plans.

Paid subscriptions are billed according to the plan, billing cycle, price and usage limits displayed at the time of subscription.

Payments are processed by Stripe. We do not store full payment card details on our servers.

You are responsible for providing accurate billing information and ensuring that payment can be completed.

Unless otherwise stated, subscription fees are charged in advance and renew automatically until cancelled.

8. Usage limits

Plans may include limits such as:

  • number of API requests;
  • number of generated PDFs;
  • number of templates;
  • number of users;
  • storage limits;
  • rate limits;
  • access to specific features.

If you exceed applicable limits, we may restrict access, apply additional charges where applicable, or require you to upgrade your plan.

We may implement technical limits to protect the stability, performance and security of the service.

9. Cancellation and refunds

You may cancel your subscription according to the cancellation options available in your account or by contacting us.

Cancellation prevents future renewals but does not automatically refund fees already paid.

Unless otherwise required by law or expressly stated, payments already made are non-refundable.

We may review refund requests on a case-by-case basis.

10. Acceptable use

You agree not to use pdfstork to:

  • violate applicable laws or regulations;
  • infringe intellectual property rights or privacy rights;
  • process or distribute illegal, fraudulent, harmful or misleading content;
  • send malicious code, spam or abusive requests;
  • attempt to gain unauthorised access to systems, accounts or data;
  • overload, disrupt or interfere with the service;
  • reverse engineer, copy or misuse the service except where permitted by law;
  • use the service in a way that could harm pdfstork, other users or third parties.

We may suspend or terminate access if we reasonably believe that your use violates these Terms or creates legal, security, operational or reputational risk.

11. Prohibited sensitive use

You should not submit highly sensitive personal data, regulated data, confidential third-party data or special categories of personal data unless you have determined that such use is lawful, necessary and appropriate for your use case.

You are responsible for ensuring that your use of pdfstork complies with any laws or regulations applicable to your industry, documents and data.

12. Intellectual property

pdfstork, including its software, API, dashboard, design, documentation, infrastructure, branding and related materials, remains the property of pdfstork or its licensors.

These Terms do not grant you ownership of pdfstork or any intellectual property rights in the service.

You may use the service only as permitted under these Terms and your selected plan.

13. Documentation and examples

We may provide documentation, examples, code snippets, templates or technical guidance.

These materials are provided for convenience and may be updated over time.

You are responsible for testing and validating your own implementation before using it in production.

14. Service availability

We aim to provide a reliable service, but we do not guarantee uninterrupted, error-free or permanent availability.

The service may be unavailable from time to time due to maintenance, updates, technical issues, security measures, third-party providers, infrastructure problems or events beyond our control.

We may modify, suspend or discontinue parts of the service where necessary.

15. Support

Support may be provided depending on the plan, availability and nature of the request.

We may assist with account issues, billing questions, API usage, debugging and general technical questions.

We do not guarantee that all support requests can be resolved, especially where the issue depends on third-party systems, customer implementation, invalid data, unsupported use cases or external infrastructure.

16. Third-party services

pdfstork may rely on third-party services for payment processing, infrastructure, email delivery, analytics, advertising measurement or other operational needs.

Your use of third-party services may be subject to their own terms and policies.

We are not responsible for third-party services outside our control.

17. Data protection

Our processing of personal data is described in our Privacy Policy.

Where pdfstork processes personal data on behalf of a Customer as a processor, a Data Processing Agreement may apply.

You are responsible for ensuring that the data you submit through pdfstork is processed lawfully and that you have the necessary rights, permissions and legal bases.

18. Confidentiality

Each party may receive non-public information from the other party in connection with the service.

Each party agrees to use reasonable care to protect confidential information and to use it only for the purposes of providing or using the service.

Confidentiality obligations do not apply to information that is publicly available, already known, independently developed, or required to be disclosed by law.

19. Disclaimer

pdfstork is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy or error-free operation.

You are responsible for determining whether pdfstork is suitable for your intended use.

20. Limitation of liability

To the maximum extent permitted by law, pdfstork shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of revenue, loss of data, business interruption or loss of goodwill.

To the maximum extent permitted by law, our total liability for any claim relating to the service shall not exceed the amount paid by you to pdfstork for the service during the three months preceding the event giving rise to the claim.

Nothing in these Terms limits liability where such limitation is not permitted by applicable law.

21. Suspension and termination

We may suspend or terminate access to pdfstork if:

  • you breach these Terms;
  • payment fails or remains overdue;
  • your use creates security, legal, operational or reputational risk;
  • your use may harm the service, other users or third parties;
  • we are required to do so by law.

You may stop using the service at any time and cancel your subscription according to the available cancellation process.

Upon termination, your right to access and use the service ends. Certain provisions of these Terms will continue to apply after termination, including provisions relating to payment obligations, intellectual property, confidentiality, disclaimers, limitation of liability and applicable law.

22. Changes to the service or Terms

We may update the service and these Terms from time to time.

If we make material changes, we may notify users by email, through the dashboard or by publishing an updated version on the website.

Continued use of pdfstork after changes become effective means that you accept the updated Terms.

23. Governing law

These Terms are governed by the laws of Switzerland, unless mandatory laws provide otherwise.

Any dispute relating to these Terms or the use of pdfstork shall be subject to the competent courts in Switzerland, unless mandatory laws provide otherwise.
